1. Agreement to Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you and Paw Commons (“Company,” “we,” “us,” or “our”), concerning your access to and use of the website https://www.packmethodprep.com/ (the “Site”).

By accessing or using the Site, you agree to be bound by these Terms. IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST DISCONTINUE USE IMMEDIATELY. We reserve the right to update these Terms at any time; continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

2. Our Services

Pack Method Prep training and related services. The Site provides information about our services and allows you to contact us, register for services, and in some cases manage your account. Our services are provided to individuals aged 18 years or older who have legal capacity to enter into contracts.

3. User Representations

By using the Site, you represent and warrant that:

  • You are at least 18 years of age and have the legal capacity to agree to these Terms
  • You will not use the Site for any unlawful or unauthorized purpose
  • You will not access the Site through automated means (bots, scripts, scrapers)
  • Any information you provide is accurate, current, and complete
  • If registering a pet in your care, you have the authority to do so on behalf of the pet’s owner

4. Prohibited Activities

You agree not to:

  • Use the Site for any purpose that violates applicable law or regulation
  • Attempt to gain unauthorized access to the Site, our systems, or other users’ accounts
  • Transmit viruses, malware, or harmful code
  • Interfere with or disrupt the Site’s functionality or security features
  • Use the Site to harass, defame, or harm any person or entity
  • Scrape, harvest, or collect information about other users
  • Reproduce, copy, or resell any portion of the Site without our express written consent
  • Use automated tools to submit forms or communications

You grant us the right to use Submissions for any lawful purpose without compensation to you. You represent that your Submissions do not violate any third party’s rights and do not contain confidential information.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SITE IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO YOUR USE OF THE SITE SHALL NOT EXCEED THE LESSER OF: (A) THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRIOR TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00).

Some state laws do not allow limitations on implied warranties or exclusion of certain damages. If these laws apply to you, some or all of the above limitations may not apply.

12. Indemnification

You agree to defend, indemnify, and hold us harmless (including our officers, directors, employees, agents, and affiliates) from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property rights; or (d) any content you submit through the Site.

13. Governing Law

These Terms are governed by the laws of the State of California and Arizona, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in San Diego County, CA}.

14. Dispute Resolution and Arbitration

14.1 Informal Resolution

Before initiating any formal dispute proceeding, you agree to first contact us at info@pawcommons.com and attempt to resolve the dispute informally for at least thirty (30) days.

14.2 Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator in San Diego County, CA, in English. The governing law shall be the substantive law of the State of California. The arbitrator’s award shall be final and binding.

14.3 Class Action Waiver

YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS OR OTHERWISE PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.

This class action waiver applies to all disputes arising under these Terms, including claims related to privacy, data collection, tracking technologies, and any alleged violations of the California Invasion of Privacy Act (CIPA), the Electronic Communications Privacy Act (ECPA), the California Consumer Privacy Act (CCPA/CPRA), the Texas Data Privacy and Security Act (TDPSA), the Children’s Online Privacy Protection Act (COPPA), or any other applicable privacy law.

14.4 Exceptions

The following are not subject to arbitration: (a) claims to enforce or protect intellectual property rights; (b) claims for injunctive relief; and (c) small claims court actions if the dispute qualifies.

15. Electronic Communications

By using the Site, you consent to receive electronic communications from us. You agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that such communication be in writing.

16. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Site.
